After the H-1B Cap:  Employment, Immigration and Travel Considerations for Your Foreign National Employees and Candidates

The presentation will provide an overview of the employment, immigration and travel issues facing foreign national employees and candidates after an H-1B Cap petition is filed on their behalf.  We will provide guidance on identifying common issues that arise with foreign national employees working pursuant to student visas, including an overview of the STEM program and "Cap Gap."  We will discuss when foreign national candidates can begin employment with your company, as well as the risks associated with hiring a candidate who has a pending or approved H-1B Cap petition with another company.  We will address the impact of changes in employment, including changes in title, work location and/or salary, on foreign national employees who have a pending or approved H-1B Cap petition. We will also offer immigration alternatives to consider if your employee or candidate is not selected in the H-1B Cap lottery.  Finally, we will provide an overview of the potential changes to the H-1B Cap lottery and STEM program.

Molly A. Carey is a Partner at the Boston, Massachusetts office of Fragomen, Del Rey, Bernsen & Loewy, LLP.  She has practiced exclusively in the field of corporate immigration and nationality law for more than 14 years. Molly provides multinational corporations, including leading e-commerce and technology companies, with strategic counseling on all matters of U.S. immigration and nationality law, regulation, policy and compliance.  Molly has served as Co-Chair and Moderator of the Massachusetts Continuing Legal Education, Inc. (MCLE) Immigration Conference from 2011 through 2014.  She is also is a member of the American Immigration Lawyers Association (AILA) and Women’s Bar Association. 

Molly provides pro bono immigration services through Kids in Need of Defense (KIND), an organization dedicated to providing representation of unaccompanied immigrant and refugee children in their deportation proceedings, as well as Project Citizenship, a nonprofit agency that helps immigrants apply for U.S. citizenship. 

Molly received her J.D. from DePaul University College of Law (2005), and Bachelor of Arts in Government from Georgetown University (1999).
